Terms and Conditions

Deep Water Creative Solutions

All services provided by Deep Water Creative Solutions are subject to the following terms and conditions. These
conditions have been put into place to protect both you the 'client' and 'Deep Water Creative Solutions'. For all
additional costs and all maintenance costs, please refer to our downloadable price list on our Services page.

Mock-up website & Quotations

A deposit of $100 will need to be paid upfront and this amount will be deducted from the final balance. We will then
discuss your website requirements with you and ask you to complete a questionnaire. On receiving the completed
questionnaire we will then build you a mock-up website.

Once you have viewed the mock-up website and requested any changes, we will then build your website. Please be
advised that all initial quotes provided by Deep Water Creative Solutions are valid for 1 month. Once that period expires,
you will need to start the process again and you will incur another deposit of $100.

Charges & Fees

The remaining balance will be due upon acceptance of the completed web development project before it is released to the
client or published on the internet.

Payments can be made by direct bank deposit (preferred), cheque or into our Paypal account (details can be supplied on
request).

Website Content

Clients are required to ensure that the content of their website meets all the current Australian legislation regarding
publications. The client shall further indemnify Deep Water Creative Solutions in respect of any claims, costs and
expenses that may arise from any material included in their site by Deep Water Creative Solutions at the client's request.
Deep Water Creative Solutions reserves the right not to include any material supplied by the client if Deep Water Creative
Solutions deems it inappropriate or offensive.

Unless otherwise specified, all text, images and materials to be incorporated in the website shall be supplied by the client
in electronic format, delivered on CD or via email, within fourteen days of acceptance of the free quote. Content received
after this period will incur extra charges (see website maintenance rates). Proof reading the supplied text and
acceptance that it is correct is the responsibility of the client.

Website Hosting

At this point in time Deep Water Creative Solutions do NOT provide the facility to host your website. We do investigate
and recommend different companies that can provide this facility for you within Australia only.

Domain Names

The client understands that they must purchase a website domain name from a Domain Name registrar. The client may
accept the recommendation of Deep Water Creative Solutions for domain name selection but this is purely up to the
client's discretion. If the client already has a domain name registered, Deep Water Creative Solutions can recommend a
company to transfer their domain to for web hosting as well.

Copyright & Ownership

Deep Water Creative Solutions retains copyright to all completed website design projects produced by Deep Water
Creative Solutions. The client will be granted rights to use the web design project as a website, upon final payment of all
incurred fees for production of the web design project. Where a client decides they wish to move their website to another
web designer, the client can purchase the code and all associated documents, photos associated with the website will be
returned to them. In addition, all relevant userid’s and passwords will be supplied once payment is received. To discuss this further,
please contact Deep Water Creative Solutions.

Alterations

Deep Water Creative Solutions will not accept any responsibility for any alterations performed by either the client or a
third party which cause errors in the website. Such alterations include, but are not limited to, additions, modifications or
deletions. If Deep Water Creative Solutions is required to correct any errors resulting from such alterations, the client will
be charged the current website maintenance rate.

Development & Delivery

Deep Water Creative Solutions understands the importance of completing projects in a timely manner. We normally
complete all projects within two weeks of receiving the deposit along with complete website content. If not all of the
website content is provided by the client, then Deep Water Creative Solutions will not be responsible for any delays in
implementing the clients web design project.

Liability

Services purchased from Deep Water Creative Solutions are provided "as is" without warranty of any kind that the web
design project will be uninterrupted or error free. In no event shall Deep Water Creative Solutions be liable to the client for
any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of the website, services,
and/or goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or
other losses directly resulting from the use of the website, services, and/or goods provided to the client. The entire risk
as to the quality and performance of the web design is with the client.

Acceptance

Please note that by paying your deposit, you are agreeing to all of our terms of service as written here. If you do not
agree with any element of our Terms of Service, please do not contact us for a quote or for web design services. Deep
Water Creative Solutions reserves the right to change or update these terms at any time without prior notice.
